The Human Rights Act of Ontario is legislation that is designed to protect individuals against many different types of discrimination and harassment. The legislation was first enacted in 1962 and to this day protects people against discrimination with respect to areas of services, accommodation, contracts, age, employment, vocational association (trade union, trade or occupational association or self-governing profession), sexual harassment and reprisals.
Every person has a right to equal treatment, but what must be remembered is that discrimination is unlawful under human rights legislation only if the discrimination is effected on the basis of one or more prohibited ground. People in our Ontario may not be denied equal opportunity because they are a member of a particular racial group or perceived racial group or because of race based characteristics or because of a marriage to or association with someone of a particular race or gender. Other prohibited grounds of Human Rights discrimination in Ontario are that of religion, sexual orientation, disability, age (18 and over, 16 and over in occupancy of accommodation), family status, the receipt of public assistance (in accommodation only) and record of offences (in employment only). Discrimination on the basis of sex is also prohibited – which includes pregnancy. Women require the right to equal treatment without discrimination because she is or may become pregnant.
