Secondly, The Ontario Ministry of Labour will listen to you.<span> </span>They do however, encourage employees and employers to try and come to a meeting of the minds and disputes before seeking assistance from the ministry.<span> </span>If you think however, that your employer is not following the minimum employment standards then you can call the employment standards information centre in Toronto at (416) 326-7160 or call toll free at 1-800-531-5551 and they will provide you with information as to how you would file a complaint with the Ministry of Labour.<span> </span></p>
<p class="MsoNormal" style="text-align: justify;">The complaints are then sent to an <em>Employment Standards Act </em>officer who will investigate, listen to both sides and come to an order which will be either in favour of the employer or against an employer for failure to comply with the <em>Employment Standards Act.<span> </span></em>The ministry has a number of options to enforce the <em>Employment Standards Act</em> in Ontario including, issuing an order to compensate, an order to reinstate and compensate, issue an order to pay wages, issue an order to pay vacation pay, or issue a ticket or can prosecute an employer under the <em>Provincial Offences Act</em>.<span> </span></p>
<p class="MsoNormal" style="text-align: justify;">Employees cannot be disciplined or penalized if they ask their employer to comply with the <em>Employment Standards Act</em> legislation or ask questions about their rights under the <em>Employment Standards Act</em>.<span> </span>If an employee files a complaint under the <em>Employment Standards Act</em> or tries to exercise his or her right under the <em>Employment Standards Act</em> they cannot be disciplined.<span> </span>Employees cannot be penalized if their employer is required to pay money it owes under an order.</p>
